论我国村民自治中的法律问题及其对策

Legal Problems in China's Villager Autonomy and Countermeasures

村民自治是伴随着我国农村经济改革进程而出现的村民自治管理模式,其经历二十余载的发展后取得了多方面成就,然而,在法学视角下村民自治制度还存在着诸多亟待解决和完善的法律问题,如基层民主不充分、经济法律制度的缺失和法律文化的薄弱等。针对上述问题进行分析,提出包含制定相关法律法规,推进法制化进程等四方面解决问题的建议,以期促进我国村民自治制度更好地贯彻,促进社会主义新农村建设的健康发展。

Villager autonomy,a model of villager self-government accompanied by the rural economic reform,has obtained many achievements after more than twenty years＇ development.However,there are still many legal problems to be solved from the perspective of law,such as the inadequate grass-roots democracy,the absence of economic and legal institutions and the weakness of legal cultures.Directing at the problems the paper proposed corresponding countermeasures including formulating relevant laws and regulations,and prompting the legalization process to promote a better implementation of villager autonomy and a healthy development of new socialist rural construction.
