中国废止死刑的条件尚不成熟——基于人道视角分析

The conditions for abolishment of death penalty are not ripe in China——From the perspective of humanitarianism

从人道并非刑罚的价值要素这一命题,可以得出基于人道废止死刑是有条件的结论。只有当死刑能够激发宽容的情感、社会已经形成稳定的宽容氛围、废止死刑所带来的风险后果能够被社会容认时,死刑才可能因崇尚人道理念而被正当地废止。当前,中国的暴力犯罪率还居高不下,死刑难以激发宽容的情感,社会没有形成稳定的宽容氛围,公众不能接受废止死刑所带来的风险后果,可见,中国基于人道废止死刑的条件尚不成熟。死刑废止运动的倒退与反复现象启示,不成熟地废止死刑必将导致死刑的恢复运动。因此,中国目前不宜废止死刑。

From the proposition that humanitarianism is not the value element of the penahy, we can conclude that the abolishment of penalty for advocating the idea of humanitarian is conditional. Death penalty could be properly and rationally abolished on humanitarianism only if capital punishment is able to stimulate the feelings of tolerance and the society has formed a stable tolerance and is ready to accept the possible consequences after abolishing the death penalty. At present, the rate of violence commitment is still high in China, the death penalty can＇t stimu- late the feeling of tolerance, the society has not still formed a stable tolerance, the public cannot accept the risk and possible consequences arising from the abolishment of the death penalty. So the current humane conditions are not ripe in China for the abolition of the death penalty. The phenomenon that the fall back and reversal of abolition campaign of death penalty indicates that abolishing the death penalty will lead to the restoration campaign of the death penalty if it be abolished. So death penalty should not be abolished in China now.
