"Classification" and "Interpretation"——Comparative Study on Justification of Judicial Norm between Two Kinds of Complicated Cases

"分类"和"解释"两类疑难案件不存在真正意义上的逻辑区别,它们紧密相关又不容易区分。通过比较可以探寻出这两类案件裁判规范证立的不同思路。在"分类"案件中,法官对裁判规范的证立应当尽最大可能陈述逻辑的展开步骤。在"解释"案件中,法官可以对案件事实与相关法律规范之间在事实与价值上的双重判断进行论证,以证明对法律规范的解释选择。

There is no real logic difference between two kinds of complicated cases about ＂classification＂ and ＂interpretation＂.They interrelate and it is not easy to make a distinction between them.We may explore the way of justification about judicial norms in two kinds of complicated cases by comparing them.The judge should illustrate logic steps as detailed as possible in cases with ＂classification＂.In cases with ＂interpretation＂,judge may prove the double judgment in facts and values between the cases and the relevant legal norms,by which judge can prove the choice about interpretation of legal norm.
