摘要
土地承包经营权转让是承包权流转的方式之一。现行法律出于维护农民长期而有保障的土地使用权,促进农业、农村经济发展和农村社会稳定等立法目的,对承包权转让作了多种限制。从私法自治理念出发,这些限制性规定并非都是效力性的强制性规范,对其违反并不当然引起承包权转让合同无效的后果。应当对合同法第52条作限缩性解释。《土地管理法》、《农村土地承包法》等相关法律应当处理好转让自由与土地管制的关系,取消承包权转让限制中的不合理规定。
The transfer of contracted land management right is a means of farm land rights' transference,In order to guarantee a long-term land use right for farmer,promote economic growth and build a stabilized society in rural areas,various restrictions have been made on the transfer of land contract rights in current laws of China.Based on the autonomy of private law principle,these restrictions should not all be mandatory,and a break of them does not all necessarily lead to the contract of transfer null and void.Therefore,the 52th article of Contract Law should be explained in a narrow fashion.The Law of Land Administration of the People's Republic of China and the Law of the Peoples Republic of China on Land Contract in Rural Areas,etc should better balance the freedom of transfer and land regulation,and abolish unreasonable restriction rules.
