论海上紧追权及其行使

On the Pursuit Right in the Sea

近些年来,海上周边态势日趋复杂,海洋权益斗争不断深入,使得关注海洋权益以维护国家利益成为研究海洋问题的基点。在我国,涉及海洋问题,面临着较为严重的形势和挑战:发生在2009年的"新星号"事件,足以引起政府及国人的关注,由此彰显的海上紧追权的行使问题也再次成为人们探讨的焦点。本文立足于国际法,以紧追权的理论和实践为主线展开行文,提出立法倡议,以期为有效执法提供法律依据。

In recent years,the protection of the marine rights has been the hot point in the studies to the marine issues with the increasingly complex situation surrounding the sea.In our country,it becomes more serious.The ＂Xinxing＂ incident drew the attention of the government and the people,and the pursuit right became the focus again.This paper studies the theory and practice of pursuit right,and then gets the legislative initiatives for effective enforcement on the international law angle.
