摘要
物权法第106条规定了善意取得制度,然而却存在一些问题。不动产不应被纳入善意取得的适用范围,对于不动产的无权处分可以用公信原则来解决。脱离物不能适用善意取得,其所有权的归属最好通过取得时效来解决。
Section 106 in Property Law provides with the system of goodwill obtaining,yet there exist some problems.Real estate acquired in goodwill obtaining should not be included in the scope;unauthorized disposition of real estate can be resolved with the public reliance principles.Thing possessed out of entrust can not be applied in goodwill obtaining,and acquisitive prescription is the best way to solve the attribution of ownership.
