摘要
在实务界和理论教学界研究的推动下，构建案例指导制度已经取得了一些实质性的进展。第一，对于建立中国案例指导制度，各界有了统一的认识，思想上不再有障碍。第二，对于如何建立中国的案例指导制度，与国外的判例制度相区分，这样的思路逐步清晰。第三，对于案例指导制度，实务部门已经在着手建立，并逐渐系统化。
Under promotion by both circles of legal practice and drcles of judsprudential teaching and research, some substantial progress has been made in the establishment of the system of guiding typical cases. Firstly, all the parties concemed have reached consensus on the establishment of guiding typical cases in China, and ideological barriers to this effect no longer exist now. Secondly, ideological guidelines on how to establish systems of guiding typical cases in China and on how to differentiate the system of case guidance in China from the system of precedents adopted by other countries have gradually become clear.
