从柏克关于跨代共同体的论述中诠释出"后代人权利"实际上违反了柏克本人的思想。跨代共同体不仅是一种虚构的想象,而且其成立的前提与其所追求的环境保护目的是相矛盾的。从"跨代共同体"到"后代人权利"只能是从一种虚构走向另一种虚构。

The theory of ＂the rights of the offsprings＂ is quite a popular theory in the field of ＂Environmental Law＂.But this paper maintains that deducing the idea of ＂ the rights of the offsprings＇ from Burke＇ s own assertation about＂ trans-generational community＂ is running against Burke＇ s own idea.＂Trans-generational community＂ is but only a illusory false appearance,furthermore,the required antecedent is self-contradictory with the environmental preservation objective to be attained.From ＂trans-generational community＂ to ＂the rights of the offsprings＂can only be from one fabrication to another fabrication.
