On Theory Foundation and Application of Circumstance Change Principle

论述了情事变更的理论依据、构成要件及该原则的效力;分析了其原则与相似观念的区别;指出了合同成立以后客观情况发生了当事人在订立合同时无法预见的、非不可抗力造成的不属于商业风险的重大变化,继续履行合同对于一方当事人明显不公平或者不能实现合同目的,当事人请求人民法院变更或者解除合同的,人民法院应当根据公平原则,并结合案件的实际情况确定是否变更或者解除,这是我国司法解释规定了的情事变更原则。

The theoretical basis,construction elements and the effectiveness of circumstance change principle are expounded.The differences between this principle and other similar concepts are analyzed.It is pointed out that after the contract,if the objective situation changes which the parties cannot foresee in the contract and do not be-long to the business adventure without force majeure to continue the contract clearly unfair for one party or pur-pose of the contract can not be achieved,the parties request the court to change or terminate the contract,People’ s court should make sure to change or terminate according to the fair principle and the actual situation of the case,this is the circumstance change principle in our judical interpretation.
