新刑法对于正当防卫的成立范围较之旧刑法更为广泛,应当认真认定正当防卫的存在范围。新刑法对于防卫过当的成立作出了严格的限定,有利于弘扬社会正气。新刑法并未增设特别防卫权,所谓的特别防卫权属于正当防卫的当然内容。
