摘要
随着国际范围内国家补偿制度的兴起,我国也出现了构建国家补偿制度的需求。从控制犯罪和保障人权的角度看,我国有必要在借鉴国外立法和司法制度的基础上,结合国情,建立具有中国特色的国家被害人补偿制度。
With the blossom of the state＇s compensation system in the wide global range,there has occurred the requirement of setting it in China.Looking over from the angle of controlling crimes and guarantee human rights,China has to base on consulting overseas legislations and judicatory systems to set it,which has Chinese characteristics,by combining with the state＇s situation.
