论行政组织法的完善路径——从行政生态学的角度切入

Perfection of administrative organization law:an administrative ecology approach

改革开放以来,我国政府机构先后进行了几次规模较大的行政改革实践与数次规模较小的调整,然而,作为行政机构改革制度保障的行政组织法的理论探讨与制度设计,却进展缓慢。近年来,行政法学者从研究主线、行政主体与合法化进路等方面,对行政组织法的完善进行了有益的探索。行政组织法的进一步完善,实际上就是行政组织相关制度对目前行政组织的生态环境所作出的一个回应。影响行政组织制度形成的生态环境是多样的,其中与之关系最为密切的包括政治、经济、文化、技术等四个方面。

Since the reform and opening up policy, China＇s government has undergone many reforms and adjustments, but the theory of the administrative organization law, as the protection of administrative reforms, has made slow progress. Over the years, many scholars have contributed a lot of useful thinking to the development of the administrative organization law from different standpoints. This article offers some suggestions on the perfection of administrative organization law from the administrative point of view of ecology, hoping to contribute to the future development of the administrative organization legal system.
