我国现阶段利益集团的特征及其在立法中的利益表达

How Interest Groups Give Expression to Their Own Interests in Modern Legislation

利益集团是利益矛盾和利益冲突的主要组织和表现形式。我国的利益集团呈现出发育的非均衡性、体制的依附性和发展的复杂性三方面特征。利益集团的利益表达,为立法机关有效化解社会利益矛盾和冲突提供了决策依据,弥补了立法信息的不对称,培育和提高了民众的民主意识和法制意识。但同时,在现代立法中还要加强对利益集团的监督,确保平等的利益表达权,消除话语权上的不平等,实现立法的公平性与社会的整体和谐,不断推动中国社会的民主法治进程。

The interest group is a major expression form of interest contradictions and interest conflicts. In China, interest groups have three features： the malconformation of growth, the structural dependence and the complex nature of development. Interest groups＇ expressing their interests provides the decision-making basis for legislative bodies defusing social interest contradictions and conflicts, makes up for the asymmetry of legislative information, fosters and raises the public＇s awareness of democracy and legal system. Meanwhile, it is necessary to strengthen oversight over interest groups so as to ensure that they have equal right to express their interests, remove unequality in speaking so as to ensure the equality of legislation and social harmony.
