我国强制隔离戒毒制度的现实困境及其完善

THE DILEMMA AND COUNTERMEASURE OF COMPULSORY ISOLATION DRUG TREATMENT SYSTEM IN CHINA

《禁毒法》强制隔离戒毒制度产生的新问题,与对原劳教戒毒和强制戒毒的老问题相互交织。虽然学者设想管理体制方面的统一整合方案,但《戒毒条例(征求意见稿)》仍维持原先体制不变,过于保守。强制隔离戒毒的"换汤不换药"以及产生的新问题让人诟病。应该合理定位强制隔离戒毒制度。强制隔离戒毒不应理解为保安处分,要避免"重惩罚、轻戒毒",重视其医疗性。强制隔离戒毒的各环节应继续完善,制定诊断评估办法,并重视对医患关系的制度建构。

The new problem of compulsory isolation drag treatment and the old problem of detention and mandatory drug treatment are intertwined. Scholars envisaged a unified management system integration aspects of the program. It is too conservative that Drug Ordinance （draft） remain unchanged. People criticized that compulsory isolation drug treatment is superficial changed and new problems have occurred. Compulsory isolation treatment should be put in a reasonable position. Compulsory isolation drug treatment should not be samed as security measures. To avoid heavy punishment, light treatment, therapeutie is more important. Compulsory isolation drug treatment should be improved in all areas. Diagnostic methods and ordinance should be drawn up. Building the system of physician -patient relationship should be given attention.
