论构建居住权制度的可能性

On the Possibility of Establish Habitatio System

本文试就在我国是否存在居住权制度赖以存续的文化制度土壤进行分析,第一部分是提出问题,就文化和制度上不能接受居住权的原因进行分析,第二部分则是通过对第一部分提出的问题进行反驳,进而得出结论无论是文化上抑或是制度上,我国均可吸纳居住权制度。

This paper makes an attempt to analyze the existence of cultural basis for establishing habitatio system.In the first part,it raises the question and analyzes the system and cultural origins for declining habitatio system.In part two,it refute the above mention question and comes to the conclusion that the introduction of inhabitatio system is acceptable in China both in terms of culture and social system.
