摘要
美国掠夺性定价行为规制理论坚持以利润最大化的理性人标准为基本标准。在认定掠夺性定价行为的司法实践中,美国联邦法院严格执行"价格低于边际成本"以及具有"补偿的合理可能性"的双重标准,注重以成本分析为基础的量化分析,表现出强烈的实证色彩。
The theory of predatory pricing regulation regards the rational person standard for profit-maximization as a principle standard in United States.The federal courts strictly enforce the double-standard that ＂the price is under marginal cost＂ and ＂it is reasonably possible to compensate for predatory pricing＂,and emphasize on the cost-based quantification analysis,which is of a strongly positive feature.
