完善我国网上药店法律的建议

Suggestion on Perfecting Law for Online Pharmacies in China

目的:提出完善我国网上药店的法律法规的建议。方法:对中国合法的26家网上药店和美国药房委员会推荐的20家网上药店(截至2010年5月)在信息发布、经营品种、咨询服务、运输配送、消费者保护等5个方面的情况进行研究,分析现行法律法规的漏洞,并提出建议。结果与结论:中国应完善网上药店在上述5个方面的法律法规。建议法律严格限制发布信息的合法性和专业性;禁止以任何方式变相销售处方药,明确规定将栏目导航分为非处方药和非药品;禁止执业医师在网上药店从事网上诊断和治疗,执业药师则须实现24小时轮班在线;具体规定药品配送时限;制定消费者权益保护包括投诉、赔偿等方面的有效措施。

OBJECTIVE：To put forward suggestions on perfecting law for online pharmacies in China.METHODS：26 Chinese legal online pharmacies and 20 American online pharmacies recommend by National Association of Boards Pharmacy were studied in respect of information publication,consultation service,scope of business,drug transportation and distribution,consumer protection.The legal leak of Chinese online pharmacies was analyzed and relevant suggestions were put forward.RESULTS CONCLUSIONS：Law for online pharmacies in China should be perfected.It is suggested to limit the legality and specialty of information,inhibit prescribed drugs sales in any way,classify navigation column into OTC drug and non-drug.It is also suggested to inhibit licensed physicians to offer online diagnosis and treatment service in the online pharmacies,regulate licensed pharmacist to offer 24 h service on line and time limit of drug distribution.Some measures should be put forward including complaint and compensation for consumer protection.
