论工会资产的财产权性质

On the Property Nature of Trade Union Assets

依据《工会法》和《民法通则》等法律的有关规定,工会具有社会团体法人的法律地位,因而享有一定的民事权利和义务,其财产性质应为社会团体法人财产。《物权法》和《工会法》的有关规定及相关司法解释、规章文件都是界定工会资产性质的准则。工会对工会会费、工会经费、工会企事业收入、政府资助和其他收入等工会资产享有所有权。当前,要尽快完善工会资产保护的法律法规,从源头上、制度上为维护工会法人财产权提供保障。

According to＂Trade Union Law＂and＂General Provisions of the Civil Law＂and some other regulations,trade union has legal status of corporate social groups.Therefore,trade unions have certain civil right and the obligation,the nature of assets of trade union should be the assets of corporate social groups.The＂Reality of Law＂,＂Trade Union Law＂ and related judicial interpretation and regulations are the criteria for defining the nature of trade union assets.Trade unions have ownership of assets such as union dues,union funds,union enterprises income,government subsidies and other income.At present,it is necessary to improve the legal protection of trade union assets so as to safeguard trade union’s property rights as corporate social groups.
