摘要
我国拖欠、侵占职工工资问题久拖不决,且有进一步泛滥之势,致使劳动领域百人以上的集体事件中一半以上是职工的讨薪事件。可见职工的劳动报酬权利得不到有效保护后患颇多。从完善立法的角度,应当堵住劳动法预留的在一定条件下可以拖欠工资的口子;将侵占职工工资的行为规定为犯罪,加大对职工劳动报酬的保护力度。
In China,the problem of wage arrears is becoming more and more serious.In the collective labor disputes involved more than 100 people,more than a half cases are the events of wage claim.From the perspective of improvement of legislation,we should block the hole that the Labor Law reserved that,employing units can delay wage under certain conditions.Besides,the occupation of employee’s wage should be defined as criminal in order to protect employee’s right to labor remuneration better.
