摘要
我国《侵权责任法》第十七条规定了统一标准的死亡赔偿,这会造成补偿不足和预防不足,无法实现侵权责任法的基本功能。正确的做法应该是对精神损害赔偿采用统一标准,而财产损害赔偿则必须体现个体差异。
The article XVII of Tort Liability Act formulates a unified standard of death compensation,which results in the inadequate compensation and the lack of prevention,and can not achieve the basic function of tort law.The correct way is to adopt uniform standards for mental damages,and property damages must reflect the individual differences.
