Interpretation of Government Accountability for Consumer Protection:from the Perspective of Risk Society

政府主导的公共治理机制能有效应对风险社会的挑战。由经济法主体政府、经营者、消费者所组成的三方结构中,政府通过管制经营者的行为,保障消费者的人身和财产权益。风险社会中为了保护消费者的合法权益,允许政府职责在一定范围内进行扩张。但行政权力在干预消费法律关系时应遵循法治国家原则和比例原则。

The government-led public governance system can cope with the challenges of risk society.In the tripartite structure,the government,operators,and consumers of the subject of economic law,the government protects personal life and property rights of consumers through behavior regulation.In risk society,to protect the legitimate rights and interests of consumers,the executive power is allowed within a certain range.But the administrative power should follow the rules of law and the principles of proportionality in the intervention of the relationship between consumers and operators.
