庭审中律师问话的语用预设分析

An Analysis of the Pragmatic Presupposition of Counsel Questions in Court Trials

文章以闻名世界的辛普森谋杀案的审讯笔录作为语料,从语用学的角度对庭审中律师问话的语用预设进行了初步研究。通过对律师问话中的语用预设进行探讨分析,旨在揭示法庭询问中律师是如何利用隐含各种预设及触发语的提问来诱使证人或被告做出有利于己方的回答,从而有效地实现自己意图的。研究表明,语用预设是法庭询问中律师常用来引导话题或设置"语言陷阱",从而从证人或被告的回答中获取有利的信息,来实现自己的问话意图的一种有效的语言策略。

The present paper is a tentative study on pragmatic presupposition of counsel questions in courtroom trials with the well-known Murder Trial transcripts of O.J.Simpson as corpus from the perspective of pragmatics.Through the analysis of the pragmatic presupposition of counsel questions,it attempts to discover how counsel effectively realize their purposes by using different kinds of questions with different types of presupposition triggers in questioning witnesses or defendants.The study shows pragmatic presupposition is an effective language strategy for counsel to guide witnesses’or defendants’answer,set up a trap and acquire favorable information for themselves in courtroom interrogation.
