参与视角下的耕地保护制度重构

Reconfiguration of Cropland Protection System Based on Participation

耕地保护制度分为数量保护和质量保护两个维度,当前我国的耕地保护主要在数量方面,质量保护较为薄弱,土地生态保护更是无从涉及。在耕地保护中注入参与理念,对耕地保护乃至农村社会稳定具有重要意义。参与理念的注入将使耕地保护目标由数量管护转向数量质量并重、保护主体由单一的政府转变为耕地使用者、农民集体经济组织等团体、政府等多种主体。笔者还构建了发挥各主体优势的具体参与机制,确保耕地得到全面保护。

Cropland protection system includes two aspects that are quantitative protection and qualitative protection. Our cropland protection system emphasizes quantitative management, but the qualitative protection is very weak, and the ecological protection is missing. Injecting participation into the cropland protection system makes sense for cropland protection and the stability of the rural society. Meanwhile, the idea of participation will make the cropland protection system to regard the quantitative protection and the qualitative protection as equally important, and make the body to be many bodies which includes government, farmers and their organizations. The author also constructs the participation mechanism that can unleash the bodies＂ advantage to ensure that the cropland can get comprehensive protection.
