亟待构建全局观念的“艺术法”体系——兼议我国非物质文化遗产保护相关立法与动向

On the Urgency of Building the Art Law System with Overall Concerns——Legislation and Development of China's Protection of Intangible Cultural Heritage

围绕着如何保护非物质文化遗产,我们还是习惯于"走一步看一步","出现问题———解决问题"的思维和模式,缺乏一种全局观念。"非遗"的保护离不开相关法律的健全。非物质文化遗产保护的相关立法属于"艺术法"体系的一个分支,正如民法体系、商法体系等一样,只有建立了全局观念的"艺术法"体系,才能使非物质文化遗产的立法做到有的放矢、事半功倍。

As to how to protect intangible cultural heritage,we are still accustomed to the pattern of ＂one step forward,the other step saved for watching＂ or ＂problems emerged,and solve problems＂,without consideration for the overall situation.The protection of intangible cultural heritage can never be complete without the perfection of the legal system.Legislation on the protection of intangible cultural heritage is a branch of the art law,a law system just like civil law or commercial law.Only the art law system with overall concerns is established can the protection of intangible cultural heritage be effective.
