和谐视阈下我国小产权房处置陷入困境的症结及路径选择

Crux and Path of Choice of China's Small Property Disposal Trouble under Harmony

在当前稳定压倒一切的政治语境下,如何对小产权房进行妥善处置,成为当前政府面临的现实难题。对于小产权房的处置应当理性对待,不能纠结于"强拆"还是"转正"这一非此即彼的传统处置模式。在构建和谐社会的视阈下,应当根据小产权房的不同情形采取区别对待的处置思路:其一,根据不同利益主体采取不同措施。对违法建造小产权房者应依法追究其责任,对购房者则应在一定程度上给予赔偿;其二,根据小产权房占用不同的土地类型采取不同措施。对于非法占用耕地或基本农田违法违规开发建设的小产权房应坚决予以取缔;其三,对那些在宅基地或农村集体建设用地上建设的小产权房,尽量做到合法处置和合理利用。

In the current political context of stability above all,how small property disposal could be properly disposed has been a practical challenge the government faces.The disposal of house property should be rationally treated,not entangled in the traditional patterns of ＂demolitions＂ or ＂positive＂ disposition.In the background of building a harmonious society,the house property should be disposed based on the different situations of it：First,various measures should be taken according to different stakeholders.The illegal construction of house property should be held accountable according to law,and to a certain extent,buyers should be given compensation;second,different measures should be taken according to the different types that house property occupies land.Those house properties of illegal occupation of farmland or illegal development and construction should be resolutely banned;third,for those house properties constructed in the homestead or rural collective construction land,we should make reasonable use of them as far as possible and take legal disposal on them.
