国际能源合作中的国家能源主权原则研究

On Energy Sovereignty Principle on International Energy Cooperation

文章介绍了作为国际能源合作的重要基础的国家能源主权原则的概念和渊源,认为国家能源主权是国家主权原则在国际能源合作中的要求,具体表现为国家对本国能源事务的自主权、国家对其境内的能源资源的永久主权、国家对境内能源外资实行国有化或征收的权力及国家对能源外资的管辖权;同时,能源主权是发展中的能源资源国谋求经济独立与发展的前提。本文认为国家能源主权原则的具体使用在新的全球能源合作机制中将面临着调整,需要适度现实国家能源主权原则,同时,需要防止滥用国家能源主权而形成的资源民族主义,从而对国际能源合作造成负面的影响。

The article introduces the definition and legal sources of energy sovereignty principle which is the important basis for international energy cooperation.As the demands for international energy cooperation,energy sovereignty manifested with the following sub-rights： independence right for the self-owned energy resources;perpetual sovereignty for the energy resources at the territory;the rights of nationalization or expropriation for foreign invested energy resources and the jurisdiction for foreign investment at energy field.And at the same time,energy sovereignty is the prerequisite for the developing energy resources countries to their economy independent and development.The article believes that the energy sovereignty principle faced adjustment under the background of new global energy cooperation mechanism.Meanwhile,it is should avoid resource nationalism to making bad effect for international energy cooperation because of abuse of energy sovereignty.
