村委会选举中的拉票行为及其规制

On the Lobbies in China's Election of Villager Committees and Its Regulation

村委会选举中有拉票行为,即证明村民手中的选票是有用的。然而,目前村委会选举中,拉票行为缺乏规制,贿选现象滋生,选举争议难断,选举暴力频发,严重损害了村民自治。在这一背景下,2009年4月份,中央出台了《关于加强和改进村民委员会选举工作的通知》。该文件对于规范拉票行为,惩治贿选,保证村民选举的有序公正,具有重要意义。不过,该文件认可"承诺捐助村集体"的拉票行为、禁止"私下拉票"等规定,尚有可商榷的余地。

The lobbies in china＇s election of villagers committees show that the villiagers＇votes are effective.However,the corresponding regulation isn＇t enough and the bribery at the election is a big problem.Consequently,＂a Notice about Strengthening and Improving the Administration of the Election of Villagers Committees＂,namely,the Central Twentieth Document,was issued jointly by the General Office of the CPC Central Committee and the General Office of the State Council.This document is meaningful in the sense of regulating the practices of lobbies and overcoming the bribery at the election,although some rules such as approving ＂the lobby of donating to the village＂ and prohibiting ＂the villagers＇spontaneous lobbies＂ have room to discuss.
