论我国民事执行检察监督体制的构建

On the establishment of the procuratorial supervision system of civil execution of our country

人民检察院有权对民事审判活动实行法律监督,但监督必须建立在知情的基础上,检察机关要想对民事执行进行有效的监督,就必须深入了解法院的民事执行及其存在的问题。当前,民事执行检察监督的必要性和合法性无须再讨论,问题是如何按照执行程序的特点和规律,具体地将执行监督落到实处。

The people＇s procuratorate have power to do legal supervision on civil judgement activity which must be based on the knowing of the case.If the procuratorial organs want to carry out effective supervision on the civil execution,they must get deep knowing of the civil execution and problems of courts.At present,the necessity and legality of the procuratorial supervision of civil execution does not need discussing.What we are concerned about is how to put execution supervision into practice according to the characteristics and law of execution procedure.
