摘要 与愈演愈烈的房价涨势相反,建于农村集体土地上的小产权房因其低廉的价格实现了众多城市居民的购房愿望,但目前我国法律并未给予小产权房相应的合法地位,往往造成司法实践中对此类问题的裁判不一,也不利于各利益主体的权利保障。对此,只有将小产权房进行合法化,明晰小产权房的权属,制定完善的小产权房管理体系,设立农村非农用地流转制度,才能更好地发挥农村集体土地的效用。 On the contrary with the trend of prices rising,"Uncompleted-Right" House built in the rural collective land satisfies the purchase desire of many city residents for its low prices.But now,there is no property and corresponding legal status concerning it in Chinese law,which often causes disunity of referee in judicial practice and also does harm to the protection of the interests of the main rights.In this connection,the legalization of "Uncompleted-Right" House,the clarity of the ownership of "Uncompleted-Right" House and the construction of the perfect management system will make the use of rural collective land more effective.We should establish the transferring system of rural non-agricultural land.
