建立“另案处理”监督机制的思考

Build up Supervision System of Separated Action

在司法实践中,由于相关法律不完善,检察机关对另案处理的监督相对薄弱。检察机关应从确定适用条件、规范监督程序、健全监督机制入手,强化对公安机关另案处理情况的监督,以此来规范公安机关的执法行为、彰显检察监督职能、维护法律公平正义。

The procuratorates＇supervision on the separated actions is weaker in judicial practice for the lake of law. Under the environment of building up harmony society,procuratorates should enhance the supervision the separated actions handed by police stations form applicable conditions,regulating supervision procedure and improving supervision system to regulate execution activities of police organs,embody procuratorate function and maintain fairness and justice.
