摘要
《鹿特丹规则》"适用范围"沿用了货物运输合同标准,兼采运输业形态标准,并引入了合同主体的参考标准,综合确定其适用范围;其适用的国际货物运输合同,包含海上运输区间的国际性和海运前、后区间的国际性,具备"双国际标准";《鹿特丹规则》处理和协调本公约与相应运输区间的法律适用的新制度设计,采取"最小网状责任制",排除了国内法适用,其一旦生效,将对我国运输法律体系和国际航运业、物流业产生重要影响。
The scope of application of Rotterdam Rules maintains the standard of contract of international carriage of goods. It adopts the status of carriage,introducing contractual parties. The standard for contract of international carriage of goods posses "double international standard " with international ocean carriage and before or after carriage by sea. Rotterdam Rules coordinate with transportation law in stages,drawing the principle of "Limited Network System". It excluds the application of national law. Once it comes into force,it would have great impact on international shipping logistics.
