黄河上游少数民族——土族的习惯法有其独特性,尤其是在法律渊源上的草原法律文化特征非常浓厚。当今,在国家主流文化与规范制度理念的影响下,土族习惯法正处于衰落和被边缘化的窘态,因此,很有必要以非物质文化的视角对土族习惯法予以关注。

As one unique ethnic people in the upstream of the Yellow River,the Tu ethnic people has its own specific customary law,and especially the source of the law has its own legal culture came from grassland.Under the state main culture and the idea of system norm,the customary law of Tu ethnic minority has been in decline,so,it is necessary to pay lot attention to it by protecting it as non-material culture.
