诉讼离婚理由这个老问题可以自合同法理这个新角度而得到新考察。视婚姻为合同的思想很有价值,但这一价值未得到充分重视。在认识婚姻的本质和基础的前提下,衡诸合同的法理,可以对诉讼离婚的理由作出科学的合乎实际的立法设计。

The reason for litigation divorce as an old problem can be inspected again in the perspective of contract theory.The idea of regarding marriage as a contract is valuable,but this value has not received adequate attention.On the condition that the essence and basis of marriage are found,judging from contract theory,the reason for litigation divorce can be planned scientifically and practically.
