和谐视野下的公法与秩序

A Study of Public Law and Order in the Perspective of Harmony

法律是定分止争、防止无序的重要手段,所以秩序成为法的基本价值。通过分析公法与秩序的内在机理出发,着重围绕"公共权利——公民权利"这一核心公法主线,从公法层面分析了公法对秩序的维护;以及在当前依法治国、构建社会主义和谐社会这一时代背景中公法对秩序维护所面临的现实困境,提出了要正确地处理好公法与秩序的关系,通过完善公法来更好地规范公权力的运行和保障公民权利的行使,以此在社会中形成安定有序的秩序与和谐的状态,促进法治社会、和谐社会的实现。

Law is an important means of preventing the disorder, so order becomes the basic value of law. Though analysis on the inner mechanism of public law and order, based on the key issue ＂public rights civil rights＂, this paper analyzed the facing challenges in maintaining of order by public law and proposed some suggestions on balance of public law and order, guarantee of civil rights, and construction of harmonious society, etc.
