自然体与后代人权利的虚构性

Fiction of the Rights of Nature and Future Generations

作为法学术语的"权利"有其独特的存在基础和作用范围,超乎其外,"权利"将不再是权利。自然体权利和后代人权利只是一种权利虚构。这种虚构是权利时代所型塑出来的权利思维模式和权利路径依赖的产物,它不仅不能实现虚构所预想的目的——解决环境危机,而且破坏了传统的权利理论。在后现代语义学中语言被异化的今天,我们必须慎重使用"权利"。

＂Right＂ as a strict term has its unique basis and scope of role. Out the basis and the scope,＂right＂ isn’t the right. The rights of nature and the rights of future generations only are fiction of rights. This fiction is the product of the shape of thinking and the path dependence out of the right time,which not only can’t achieve the desired purpose——to solve the environmental crisis,but also undermine the traditional theory of rights. At the present of aliened language in the postmodern semantics,we must prudently use ＂right＂.
