著作财产权的本质权益是传播权,即控制向公众传播的利益。明确著作财产权的传播权基础,可以为划清著作财产权与个人使用之间的界线提供必要的参照。个人使用应采广义的理解方式,视同私人使用,包括个人复制及个人演绎行为。同时,在对个人使用界定时,应强调使用者的非营利目的和使用的非公开范围。
The property right nature of copyright is dissemination right, which is the interest of communication right to the public. Making it clear that the basis of copyright is dissemination right, it can provide the reference marks for drawing a clear distinction between the property right of copyright and personal use. Personal use should be broadly regarded as private use, including personal copying and personal derived act. In addition, when making definition for personal use, we should emphasize the characters of non-business purpose and private space for use.
