农地所有者对其土地具有占有、使用和收益的权利,是土地物权化的种,针对农地使用权的立法工作,土地管理部门应该从公平的角度进行优化,使农地使用权制度化,规范化。关于农地在交易实施过程中的所有权问题,在交易时应该如何改善其环境条件,是培育、建立农地使用权交易市场的前提、基础。

The farmland-use right is one of the farmers＇ property rights for possessing,using and earning within their land contracts. The legitimate value orientation in the system construction for the transaction of the farmland -use right should be based on the principle of fairness,and establishing a trading model in which farmers ＇ farmland-use right should be recognized as one of their property rights. And the author holds that the establishment of trading market is the precondition for the trading system construction for the transaction of the farmland-use right.
