检察环节刑事不合法证据的转化与补救

Transfer and Remedy of Illegal Evidence in Procuratorial Stage

非法证据违反了证据的合法性原则,但违反证据合法性的并非都是非法证据,对于这些证据不能以非法证据排除规则简单的予以排除,在检察审查逮捕、审查起诉环节可以采取合法的转化手段予以补救。

Illegal evidence violates the principle of legality of evidence,but all that violate legality of evidence are not necessarily illegal evidence,which cannot be removed simply according to the exclusive rules of illegal evidence.Legal transfer should be adopted to remedy the illegal evidence in the procuratorial process of investigation,arrest and prosecution.
