现实与法律的冲突和规制——基于利益衡平视角的拆迁中违章建筑补偿问题探究

The Conflict & Regulations between Reality and Law:Study on the Equity Compensation for the Demolition of Illegal Buildings from the Perspective of Interest Balance

中国正在社会转型,社会变迁带来纠纷增长,矛盾凸显,我国已进入了高风险社会。拆迁被称为当今"天下第一难事",其中违章建筑的拆迁补偿问题尤为复杂,理论界和实务界分歧很大。违章建筑到底该不该补偿,大多数学者对于违章建筑的定性,一定程度上将原本属于两个层面的问题混淆到一个层面,容易导致对违章建筑定性的模糊不清。对于违章建筑的补偿不应采取"一刀切"的标准予以全部否定,应对违章建筑的定义、财产性质及权属进行详细地分析,揭开违章建筑的面纱,进行甄别,然后在市场比较法、收益法的基础上提出新型的租金定价模式。

Modern China is in the stage of social transformation from traditional society to modern society,and social vicissitude has brought more and more disputes and contradictions.China has entered a high-risk society.Demolition is known as ＂the most difficult thing in the world ＂,in which the compensation for the demolition of illegal buildings is more complex in theoretical and practical fields.Should the demolition of illegal buildings be compensated？ For the division of illegal construction,most scholars qualitatively define two levels of issues to a single level,which causes the confusion of the illegal construction.The author believes that the compensation for the illegal constructions should not adopt a ＂blanket＂ standard to negate all of them.A detail analysis should be made for the definition of illegal construction,property nature and private ownership to reveal the veil of illegal construction and discriminate them.Then the new rent-pricing model should be established based on market comparison and income.
