通过对我国犯罪嫌疑人近亲属在法律地位中的困境的考察和对犯罪嫌疑人近亲属处境的人性化分析,阐述了维护犯罪嫌疑人近亲属权益的必要性及措施。提出应构建犯罪嫌疑人近亲属拒证权,完善犯罪嫌疑人近亲属辩护权,构建犯罪嫌疑人近亲属精神财产损失的救济制度。

The necessity and measures of maintaining the rights and interests of close relatives of suspects are expounded,through the investigation on their plight in legal status and the humanism analysis on their situation.The following aspects about maintaining the rights and interests of close relatives of suspects are recommended： establishing the right to reject testifying;improving the right to defense;and building the relief system on their moral damage.
