摘要
《监督法》生效后,全国大部分省级人大常委会都通过制定地方性法规,对规范文件备案审查的范围作出明确规定。不过,这些地方性法规对规范性文件的界定以及对规范性文件的表现形式的列举五花八门,以致对法制统一原则构成威胁。省级人大常委会应当根据《宪法》、《地方各级人民代表大会和地方各级人民政府组织法》、《立法法》以及《监督法》的规定或授权,科学合理地确定规范性文件备案审查的范围。具体来说,在界定规范性文件的内涵时,应重点说明"规范性"的内涵;在列举规范性文件的表现形式时,应以列举制定主体为主线,特别是要明确县级以上地方人民政府工作部门、地方人民法院与地方人民检察院、乡镇级人民政府等制定的规范性文件应否接受县级以上人大常委会的备案审查等事宜。
After Law of the People's Republic of China on Supervision by the Standing Committees of the People's Congresses at All Levels taking effect,most of the provincial Standing Committee of the People's Congresses have enacted local regulations to express the scope of Recording Review on Normalizative Document of Law explicitly.However,these local regulations are diverse in the definitions and enumeration on Normalizative Document of Law,which even can threaten the uniformity of the legal system.According to Constitution of the People's Republic of China,Organic Law of the Local People's Congresses and Local People's Governments of the People's Republic of China,Legislation Law of the People's Republic of China,and Law of the People's Republic of China on Supervision by the Standing Committees of the People's Congresses at All Levels,the Provincial Standing Committee of the People's Congress should define the scope of Recording Review on Normalizative Document of Law in a reasonable and scientific way.Specifically speaking,when defining the conception of Normalizative Document of Law,the 'normalization' should be specially demonstrated;when enumerating the types of Normalizative Document of Law,enumerating the lawmakers should be paramount.It should be especially defined whether the Normalizative Document of Law made by the departments of Local Governments at or above the county level,Local People's Courts,Local People's Procuratorates and the Local Governments at the town level,should be recording-reviewed by the Standing Committee of the People's Congresses above the county level.
