“小产权房”的成因分析及对策建议 被引量:6

摘要 基于目前住房市场上"小产权房"交易火热这一现象,首先,文章分析了"小产权房"交易火热的直接原因,即"小产权房"的低价,而其深层原因在于我国长期形成的城乡二元土地结构,从而导致集体土地产权不明晰。然后基于各主体之间的利益之争,从利益驱动角度分析了"小产权房"的成因。其次,文章提出购买"小产权房"存在的法律风险。最后,结合目前"小产权房"市场的具体情况,提出了相关政策建议:即建设城乡一体化土地流转制度;明确集体土地的产权主体;增加农地征收补偿;对"小产权房"进行产权管理等。 The paper firstly analyzed the direct reason of the phenomenon of hot deal to "small property room" in the current housing market is a low price,and the underlying reason is the urban-rural land structure,that experienced a long-term,which caused the collective land ownership was not clear.Then, based on the interests of each actor,the paper also analyzed the reason of "small property room" from the point of the interest-driven.Secondly,the paper proposed the purchase of "small property room" of the legal risk.Finally,according to the current housing market situation,the paper put forward some relevant policy recommendations: constructing urban-rural land transfer system;clearing collective land property rights;increasing compensation for expropriation of agricultural land;implementing the property management for "small property room",etc.
