中外商业秘密保护法律制度比较研究

Comparative Study of Legal System of Business Secrets Protection at Home and Abroad

商业秘密的复杂性决定了各国对其保护所采取的法律手段的多样性,国内外针对商业秘密保护的立法差别显著,且均存在不足之处。本文通过对国内外与商业秘密保护相关的法律法规进行了梳理,总结出目前存在的立法"短板",并在此基础上提出了改进措施,以促进我国不断推进商业秘密立法建设。

The complexity of business secrets causes the diversity of safeguard measures taken by various countries.Comparing to China,foreign law is remarkablely different on lawmaking of business secrets protection.But in general,both of them have defects.This paper analyzes the two legislations and summarizes their deficiency,hoping to perfect it and brings forward some suggestions for legislation of business secrets protection at home.
