On Legislation to Protect Folk Performing Arts Group Performancers' Right of Pursuit

民间表演艺术集体表演者追索权是表演者权的重要内容,是新型独立权,因为其特殊性而相似但区别于邻接权。对该权利的保护,外国立法及国际公约均有规定,我国无明确立法。保护该权利对文化发展与民间艺术产业发展有重要意义。我国未来应该在权利主体、行使方法、保护期限、实施保障等方面对该权利进行立法保护。

Folk performing arts group performancers＇ right of pursuit is an important aspect of performer＇s rights and a kind of new independent right.It is similar but distinct from neighboring rights because of its uniqueness.The protection of right has been stipulated in foreign countries and international conventions,except China.To protect the right in China is of great significance for development of folk arts industry and culture.Chinese legislation to protect the right should include subjects of rights,the exercise methods,the term of protection,security and implementation and other aspects.
