结构与功能是法律意识形态研究的关键论题,两者分别侧重从静态与动态、内在与外在等角度全面呈现法律意识形态的整体面貌与品性。法律意识形态的结构由法律知识、法律价值与法律策略三要素构成,三要素之间呈相互支撑、相互渗透与影响的关系状态。法律意识形态的功能包括内在与外在两个层次:法律意识形态的内在功能是法律意识形态内在构成要素及其互动关系之于法律意识形态自身的作用与意义;外在功能是法律意识形态作为一个子系统对于外在环境所具有的作用与意义。同时,内在与外在功能各自存在着积极与消极两个方面。

It is a key topic to study the structure and function of legal ideology. The structural annotation and functional analysis present the overall appearance and characters of legal ideology from the static and the dynamic, intrinsic and external perspectives. In the view of system theory, the structure of legal ideology decides its essential characteristic, and the function shows its operating rule. The stueture of legal ideology is made up of three elements ： legal knowledge, legal value and legal strategy which are interacting upon each other. The function of legal ideology, which includes two levels ： internal and external, and has two aspects ： active and passive, aims to discuss the significance of legal ideology towards itself and external environment as a subsystem.
