违反城乡规划的惩戒性立法探索——以《重庆市城乡规划违法违纪行为处分规定》为例

LEGISLATION ON THE VIOLATION OF URBAN AND RURAL PLANNING ACT: A CASE STUDY OF CHONGQING

以省级政府规章《重庆市城乡规划违法违纪行为处分规定》为例,从立法背景、惩戒对象、惩戒条件、城乡规划违法违纪行为认定的依据、被惩戒行为和主体分类、惩戒形式等六个方面,对违反城乡规划的惩戒性立法进行了分析,以期对我国城乡规划领域的惩戒制度的构建有所启示。

With Regulation on Penalty to the Violation of Urban and Rural Planning Act in Chongqing as an example,this paper analyzes the legislation on the behaviors violating the provisions of Urban and Rural Planning Act from the aspects of background,penalty scope,penalty conditions,evidence to identify the illegal behaviors,classification of behaviors and people and to be laid penalty,forms of penalty etc..
