作为国家司法机关吸收非司法职业人员参加案件审判的现代陪审制度,体现公正、民主、自由等方面的价值。我国的陪审制度存在形式化、边缘化的实质,应当从陪审人员的选择、陪审案件的范围、陪审制度的运作程序与实效等方面加以完善。

The modern jury system absorbs non-judicial career as a state judicial officers to participate in trials,showing justice,democracy and freedom.Chinese jury system has shortcomings as formal and marginalization and should improve it from the jury＇s members,jury＇s cases scope,jury＇s procedure and effect,etc.
