论传统知识的知识产权保护正当性及其困境

Justification and Dilemma of the Protection of Intellectual Property of Traditional Knowledge

随着科学技术的发展,传统知识由于其自身广泛的利用价值而日益受到世界各国的关注。然而,由于传统知识自身的特点使之不能得到现行知识产权制度的有效保护。传统知识具有知识产权保护的人权基础、文化内涵和经济价值。通过分析目前传统知识的知识产权保护所遇到的困境,希望为我国传统知识保护制度的建立奠定一定的理论前提。

With the development of science and technology,traditional knowledge has aroused the world＇s attention because of its increasingly widespread use of value.However,due to its characteristics,traditional knowledge can not be effectively protected by intellectual property system.The traditional knowledge provides the basis of human rights,cultural meaning and economic value for intellectual property protection.Through the analysis of the difficulties encountered by current intellectual property protection of traditional knowledge,it is hoped to lay a theoretical premise for the establishment of the protection of traditional knowledge.
