The Socialized Perspective of Higher-up Petitions Involving Criminal Lawsuit

随着刑事涉诉上访的日益增加,表明涉诉上访不仅是一种法律问题,更是一种社会问题。我们不应仅谴责它对法治的破坏,也要认识到司法救济渠道不畅的原因。政府在处置上访活动中不能只采取打压和制裁的方式,最重要的是转变观念,运用社会化视野,宽容地看待这种现象和其折射出的社会转型期的深层矛盾。只有更新观念,转变管理方式,消除矛盾产生的社会原因,才能从根本上实现社会的稳定和和谐。

The right of petitions as a kind of democratic rights belong to citizens,but the proliferation of higher-up petitions involving criminal procuratorial suit means that it is not only a kind of legal issues,but also a kind of social problems.We should not condemn merely its destructive effect to the rule of law,and should recognize exactly the cause from obstacles of the judicial relief channel.Instead of only taking down and punishment in the disposal of petitions,the government should change the ideas,utilize the socialization vision and tolerate this phenomenon and deep contradictions this social transition reflected.Only through renewing the idea,changing the mode of the governance,improving judicial system and eliminating the social reasons of conflicts,can our government realize the social stability and harmony.
