自由心证模式下,一个案件能否得到公正处理,案件当事人是否相信在诉讼中得到了公正对待,与法官在处理案件过程中所体现出的职业道德水平的高低有很大的关系。法官的职业道德在现实生活中无时不受到权力、利益、人情等因素的考验。以道德的基本属性为基础,充分利用道德的制约方式,帮助法官坚定道德信仰,正确面对各种压力,全方位打造纯洁的司法环境,是现阶段我国司法实践中应解决的重要问题。

In free proof mode, whether a case can be dealt with fairly and whether the parties believe they receive fair treatment is closely related to the professional ethics of the judge handling the case. The judge＇ s profes- sional ethics is influenced in real life by various factors： power, interests, human relations, etc. It is an important issue for us to establish a pure legal environment and make full use of the ethical constraint to help judges firm their ethical belief, thus they can face properly various pressures.
